CS writes to Chief PMG to stop unwarranted reversion from ad-hoc appointment on regular appointment.

Sub:- Request to stop unwarranted reversion from ad-hoc appointment on regular appointment.

Respected Sir,

This is in continuation of this Association Letter No. AIAIPASP/Corr-1/06/2015 dated29/04/2015 (copy enclosed). If the ad-hoc promotion is followed by a regular appointment without break, the Government Servant can exercise option to choose the date for fixation of Pay under FR-22(I)(a)(1)  within one month from the date of such regular appointment and the option shall be admissible from the date of initial appointment / promotion. Regular appointment without break from Ad-hoc promotion is admissible under rules and this was the practice in Odisha Circle also.

It is to mention that Shri Prasanna Ku. Patra, Shri Ashwin Ku. Panda, Shri P.K. Sahoo, Shri Sarbeswar Mishra, Shri B.B. Mohanty, Shri Ajit Ku. Das and others who were promoted to Postal Service Group-B cadre on regular basis vide Directorate Order No.9-23/2012-SPG dated 28/12/2012 and Shri Simanchal Kar, Shri Mukunda Behera and others who were promoted to Postal Service Group-B cadre on regular basis vide Directorate Order No.9-23/2013-SPG dated 10/10/2013 were given regular appointment without break from ad-hoc promotion by this Circle. Similarly in case of regular appointment in ASP Cadre the officers were given regular appointment without break from ad-hoc promotion. Circle Office Memo No. ST/2-4(2)/2011/Ch-II dated 30-11-2011, Memo No.ST/24-15(1)/2004 dated 15-03-2012, Memo No.ST/24-15(1)/2012 dated 15-04-2013 and Memo No.ST/24-15(1)/2012 dated 13-03-2014 are cited as examples.

Apparently this set practice which is permissible within the Rule is reversed in the recent past though there is no change in ruling position. As a result the officers on ad-hoc promotion, are being deprived from the natural justice which is admissible under rules, by reverting to them to their substantive cadre at the time of regular appointment. Therefore, this Association urges to stop such unwarranted reversion from ad-hoc promotion on regular appointment.

I would also like to draw your kind attention to Department of Posts (Personnel Division) Order No.2-20/2014-SPG dated 3rd July, 2015 wherein 20(Twenty) Senior Time Scale (STS) officers of the Indian Postal Service (IPos), Group-A have been given regular appointment in Junior Administrative Grade(JAG) without break from their Ad-hoc appointment in JAG (copy enclosed). In one Department there can’t be two set of Rules/Practices. Similarly, there should not be reversal in the set practice/Rule for the wrong interpretation of rules which is happening in Odisha Circle.

Recently 6 (Six) Officers from Odisha Circle have been promoted to PS Group- cadre vide Department of Posts Order No. 9-25/2014-SPG dated 14-07-2015 (copy enclosed). Out of these 6 (Six) Officers, 4 (four) Officers are now on ad-hoc appointment in PS Group-cadre and if they are reverted to their substantive cadre to give them a break on their regular appointment in PS Group- cadre it will be great injustice to them. Nowhere, it has been mentioned that it is essential or desirable to give a break from the ad-hoc appointment before regular appointment.  

I, on behalf of this Association request your good self to intervene in the matter in time to ensure justice and to stop unwarranted reversion from ad-hoc appointment on regular appointment.
