Shri Jeeban Sahu on getting nomination for promotion to JTS Gr.A was allotted to Chhatisgarh Circle. He declined the promotion on the ground that he is not in position to join in another Circle due to personal reasons. He was then reverted from his officiating position as Manager, PPP, Bhubaneswar and posted as Supdt, CSD, Bhubaneswar where he is now continuing. In the mean time, Directorate reconsidered his case and re-allotted him to Odisha Circle for promotion to JTS Gr.A grade.

Sri Sahu is posted as Manager, PPP, Bhubaneswar on 29.12.2011 vice Sri R N Pradhan who proceeded on leave ahead of his retirement on superannuation on 31.01.2012.

The Anna Hazare movement has helped bring into sharp focus infirmities in the parliamentary democracy system being practised today.

This is how to Mr N. R. Madhava Menon, a former director of the National Judicial Academy in Bhopal, chose to put the social activist's stir in perspective.

The occasion was a lecture organised at the Legislative Complex here on Tuesday in connection with the diamond jubilee of Kerala Legislative Secretariat.

The issue of corruption aside, what seemed to be engaging the minds of all concerned is whether the system represents the one originally envisaged by the makers of the Constitution, Mr Menon said.

Effective governance calls for the enactment of effective laws. But Bills are passed these days without so much as a discussion in both Parliament and Legislatures.

Mr Menon quoted former Union Home Secretary Madhav Godbole, who had studied the functioning of parliamentary democracy, to show how Parliament has been marginalised in its role as an ultimate law-making institution. “Apart from continuous disruption of proceedings and consequent reduction in the duration of sessions, there has been hasty passage of legislations without any discussion, curtailment of Question Hour, open defiance of the Speaker and abuse of legislative privileges. “If in the 1950's the duration of Parliament sittings averaged 130 days a year, it has come down to less than 50 days in 2008…In 2008, on the last day of a session, eight Bills were rushed through in less than 17 minutes with no discussion whatsoever…”

“The story is not much different in many State Assemblies,” Mr Menon said.

The large gap between public expectations and performance of Legislatures was partly because neither Parliament nor State Legislatures thought it necessary to submit themselves to any independent scrutiny of their functioning.

They had also not taken cognisance of the ongoing reforms and prevailing best practices in other democracies.

The greatest challenge before law makers is how to accomplish systemic changes and structural reforms to suit the requirements of efficient law-making in a dynamically evolving polity, economy and society, Mr Menon said.

The times are such that some sections of the public have even started to doubt the relevance of the Cabinet system of parliamentary democracy for a large and diverse nation like India.

Lack of a strong and united Opposition and a truly representative Government has in some cases created an imbalance in the power equation within and outside legislatures.

This could weaken the parliamentary system, even leading at times to totalitarian tendencies and executive non-accountability.

Punjab  and  Haryana  IPASP Association  jointly  filed  CAT  case  in  Hon'ble  CAT  Bench  at Chandigarh  for the following reliefs:

Quash the letter dated 3.10.2011 by which Limited Departmental Examination for Promotion to the cadre of Sr. Postmaster(Gazetted)  has been ordered to be held on 31.12.2011 which is against the Department of Posts, Postal Supdts/Postmaster Group B Recruitment Rules, 1987 as amended from time to time as there is no vacant post in the quota prescribed under the rules as detailed in the preceding paras.

Quash the letter dated 29.11.2011 by which the applicants have been informed that ASPO are not eligible for appearing in the examination.

Quash the Department of Posts, Senior Postmaster (Group B Gazetted), Postmaster (Grade ‘III and II-Group B non-Gazetted) and Postmaster (Grade I-Group C Non-Gazetted) Recruitment Rules, 2010, i.e Postmasters Cadre Rules, 2010 run contrary to the Postal Services Postmaster Group B Rules, 1987 as amended from time to time, as the quota of the Inspector Line, has also been reduced from 19% and 75% by carving out the posts. 

Issue direction to the respondents to consider the case of the members of the applicant No 1 Union and other applicants for promotion under these rules of 1987 in their quota and promote them from due date with all the consequential benefits and it be declared that the bifurcation of quota now carried out by the respondents is illegal, arbitrary and bereft of any discernible principle.

Any other order or direction deemed fit and proper in the facts and circumstances of the case may also kindly be issued in favour of the applicants.

Above said OA no.1328/HR/2011 has been admitted by the Hon’ble CAT Chandigarh bench and notice of motion has been issued for 05/01/2012 with the interim orders to the respondent. We will receive copy of the interim relief with in one and two days.

It is now Conference time

Notification has been issued by CHQ for holding the All India Conference of AIAIASP from 27th Janurary 2012 to 29th January 2012 at Bangalore .

The next biennial Circle Conference of AIAIASP, Odisha Circle Branch is to be held on 14-15 January 2012 to deliberate on issues that are to be discussed at CHQ and to elect a new executive body of the Association before the term of the existing body expires on 24.01.2012. Notification for Circle Conference is being issued shortly.

Members of AIAIASP, Odisha Circle Branch are requested to get themselves ready to join the Circle Conference. They are requested to donate at least Rs.500/- each to the Association to be sent through eMO / messenger to Shri Pitabasa Jena, Treasurer, AIAIASP, Odisha Circle Branch, Bhubaneswar 751001. Part of the donation will be utilised to meet expenses on Circle Conference and the rest will be remitted to CHQ for All India Conference. Names of the members with the amount donated will be published in this blog.

New Manager for PPP Bhubaneswar

Shri Rabi Narayan Pradhan, the JTS Gr.A Officer re-allotted from WB Circle to Odisha Circle has joined as Manager, PPP, Bhubaneswar on 09.12.2011, relieving Shri Jeeban Sahu who is posted as Supdt, CSD, Bhubaneswar.

Too late, if not too little!

After a long wait, the Department has this time, at least, shown some positive signs for improving the career prospects of IP cadre by signaling through the meetings of cadre restructuring committee that 500 posts of ASPs could be upgraded to PS Gr.B cadre for creating more promotional avenues for IP cadre. Well, the proposal is no doubt good given the historical background that upgradtion of 248 posts to PS Gr.B cadre initiated in 1989 through  2^nd cadre review did not see the light of the day. But there is nothing to be cheered about. At present an IP gets regular promotion to PS Gr.B through DPC nomination not before 23 years of service in IP cadre( as observed from the fact that IPs of 1988 Batch have started getting nomination to PS Gr.B cadre this year only). The proposed upgradation of 500 posts of ASPs to PS Gr.B cadre will certainly decrease the waiting time for getting promotion to PS Gr.B cadre through DPC to some extent. But its impact will be so minimal and ineffective that the real benefit cannot be realized practically.

It is a good sign that the Department has now in its mind to allow GP of Rs.4600/- to IPs at the initial stage, though merger of IP and ASP cadre with surrender of gazetted status of ASPs is a necessary condition.  The Govt. has now an obligation to carry out the orders of Hon’ble CAT, Ernakulam Bench for allowing GPof Rs.4600/- to IPs at the initial stage. Either way, grant of GP of Rs.4600/- to IPs at the initial stage is inescapable.  While applying the rules of MACPS, an IP with more that 20 years of service in IP cadre will get financial upgradtion to GP of Rs.5400/-. Almost all the ASPs who would be considered for promotion to the zone of promotion through the proposed upgradtion of 500 posts of ASPs to PS Gr.B cadre would certainly be at the stage with GP of Rs.5400/-.  If the Department actually implements the proposal of upgradation of 500 posts of ASPs to PS Gr.B cadre, all concerned ASPs having a GP of Rs.5400/- will get promotion to PS Gr.B cadre with a GP of Rs.4800/-!  It is for everybody to judge whether in terms of financial benefit it will be a promotion or a demotion! Had the Department implemented the 2^nd cadre review by upgrading 248 posts to PS Gr.B cadre in 1989, it would have brought some solace to Inspectorial staff by allowing some promotional benefit to IP line officials at the fag end of their service career. But hoping against hopes, many of them retired as ASPs. The proposal of upgradation of 500 posts of ASPs to PS Gr.B cadre has come at a time, when the charm and impact of promotion is neutralized on implementation of MACPS.  Who will need a promotion from GP of RS.5400/- as IP to GP of Rs.4800/- to PS Gr.B cadre these days, that too with risk and responsibility that Hercules alone can lift?  After all, the number of posts of IP line will remain static. As proposed, there will be some changes in designations only, without any financial benefit. If the Govt. is so magnanimous, it should think of upgrading some posts of PAs/ SAs to IP cadre by creating IP posts to look after technology and business development aspects so that Gr.C cadre can get some more promotional benefit and IP cadre will, at the same time, get some relaxation from the ever-increasing workload.

It is advisable that instead of laying stress on the so-called cadre restructuring of IP cadre, the AIAIASP should concentrate on implementation of orders of Hon’ble CAT, Ernakulam Bench to get GP of Rs.4600/- for IPs at the earliest. Upgradation of GP of IPs to Rs.4600/- will take care of most of the things that the IP cadre is now struggling to get.

Odisha Circle Branch of AIAIASP, as usual, will emphasize the need of getting GP of Rs.4600/- for IPs at any cost. Surrender of gazetted status of ASPs is a non-issue for all practical purposes. This is what Odisha Circle Branch of AIAIASP has been saying not now, but advocating consistently since last two years at every forum and every occasion.  There is no change in the views repeatedly expressed by AIAIASP, Odisha Circle Branch. It is expected that the CHQ will move in the direction of getting enhanced GP of IPs as fast as possible.

BIS launches programme to create awareness about Hallmarking

AMRITSAR: Indian consumer was very often victim of irregular gold quality and the awareness programmes being organized by Bureau of Indian Standards (BIS) would provide a useful opportunity not only to consumers but also to jewelers to clear their misconception abouthallmarking of gold jewellery, said Alka Panda, Additional Director General, Bureau of Indian Standards in her address at a awareness programme for jewellers organized here on Thursday . 

Panda urged the jewellers to take maximum benefits of BIS Hallmarking scheme in order to create their credibility and provide complete customer satisfaction. She further informed that in order to promote gold hallmarking among consumers and to bring more jewellers under assaying ambit, government of India was giving one time financial incentive of 30% of the cost of machinery and equipments for setting up of Hallmarking and Assaying Centers. 

As on October 31st 2011, there were 8650 operative licenses for gold jewellery and 162 BIS recognized Assaying and Hallmarking Centers in India. So far 1180.48 lakh articles had been hallmarked, she informed. KK Narang, Deputy Director General (North), BIS Chandigarh while giving the programme objectives, informed that BIS was organizing lot of awareness programmes in the region for the promotion of hallmarking schemes. 

She informed that there were 688 operative licenses and 11 Hallmarking centers under theNorthern Regional Office of BIS.Anil Kumar Arora, Head, Hallmarking, BIS Headquarters explained about the scheme of Hallmarking of Gold jewellery. He informed the BIS had rationalized the fee structure for jewellers and also simplified the procedure for grant of license.
