CS writes to CPMG regarding sending of Shri R.K. Pradhan, the then ASP I/c, Kendrapara Sub-Divn on leave by the Administration.

Sub: Regarding sending of Shri R.K. Pradhan, the then ASP I/c, Kendrapara Sub-Divn on leave by the Administration.

Respected Sir,

Shri R.K. Pradhan, now ASP(HQ), Sundargarh Division while working as ASP I/c, Kendrapara Sub-Divn was asked to proceed on leave for indefinite period vide SPOs, Cuttack North Division letter No.SP/Con dated 13-12-2013 as per the directives of the administrative authority (as mentioned in the said letter). Said Shri Paradhan, was relieved from duty on 18-12-2013 by the Divisional administration, and ultimately he has to remain on leave from 18-12-2013 to 07-01-2014. Shri Pradhan was also transferred untimely as ASP(HQ), Sundargarh Division vide C.O. Memo No. ST/24-15(2)/2013 07-01-2014.

It is to mention that the Central Civil Services ( Leave) Rules, 1972 is applied to Shri Pradhan being a Central Government Servant and instructing him to go on leave and debiting the leave period from his leave account (SPOs Cuttack North Division sanction Memo No.B1-39 dated 30-01-2014) is not in conformity of the said rule or any other rule. On his representation to the Circle Administration, he has been intimated vide C.O. letter No.ST/24-15(4)/2000 dated 21-02-2014 that no such instruction was issued by competent authority.

If the instruction was issued to the SPOs, Cuttack North Division or not is an internal matter of the administration, and, therefore, the Association is not interested on it. However, this Association believes that asking the official to proceed on leave for such a long period and transferring him to a distant place of about 500 Km at the flag end of his service career is a travesty of justice and fair play. This has definitely sent a wrong message to the entire Inspectorial cadre across the Circle.

Circle Working Committee of this Association on 04-05-2014 at Bhubaneswar discussed the issue and unanimously resolved to urge the Chief Postmaster General to personally look into the matter to uphold the justice and fair play ”.

I, on behalf of this Association request your good self to take an appropriate decision in the matter so that the leave account of Shri Pradhan is not affected for the period from 18-12-2013 to 07-01-2014 and to ensure that no such irregular order is issued in future.
