House panel agrees on Rs 3L tax exemption

There is now consensus among members of the parliamentary committee on finance which is scrutinising the Direct Taxes Code (DTC) Bill to raise the tax exemption limit to Rs. 3 lakh per annum and the tax-saving investments limit to Rs. 2.5 lakh.

The committee, headed by BJP leader and former finance minister Yashwant Sinha, on Friday met to discuss the bill and there was an agreement to raise tax exemption to give relief to the middle class, which is facing high inflation. Earlier, some members had wanted the tax exemption level raised to Rs. 5 lakh. The standing committee on finance has decided to finalise its report on the DTC by March 2.

Even some Congress members who met Union finance minister Pranab Mukherjee on Thursday for pre-Budget consultations asked for a substantial increase in the tax exemption limit to provide relief to the middle class.

Currently the tax exemption limit is Rs. 1.80 lakh for men and Rs. 1.90 lakh for women. The DTC Bill, which was introduced in Parliament, had proposed that the tax exemption limit be set at Rs. 2 lakh.

The current tax-saving investment limit — which includes investments in provident fund, life insurance, children’s education and infrastructure bonds — is Rs. 1.2 lakh. The committee wants it raised to Rs. 2.5 lakh.
The DTC Bill introduced by the government had raised the tax-saving deduction limit to Rs. 3 lakh. The bill proposed that people could invest up to Rs. 1 lakh in long-term saving instruments like provident funds, superannuation funds, gratuity funds and pension funds, and withdrawals from these funds will not be taxed. People can claim tax deduction up to Rs. 50,000 on expenses like tuition fees of children, pure life insurance premiums and health insurance payments. The bill had also proposed that Rs. 1.5 lakh interest paid on construction or acquisition of property for self-use could be claimed for tax deduction.
The government had proposed in the bill that there would be a separate deduction for interest on education loans and for payments of expenses of disabled persons.
Five-year bank FDs and ELSS schemes of mutual funds had been removed as tax-saving instruments by the DTC Bill. Profits earned on equity mutual funds held for one year will not be taxed. The government has retained zero long-term capital gains tax on stocks; this means shares held for more than a year will not be taxed.

Postmen to now collect data for calculation of rural Consumer Price Index (CPI)

NEW DELHI: The postman in rural areas across the country has his hands full. Apart from his regular job, he now has to go out three to four times a week to collect data from retail outlets which is then used to calculate the rural consumer price inflation.

Faced with an acute manpower shortage, the ministry of statistics and programme implementation tied up with the department of posts to get over the problem of collecting such massive amount of data from rural areas across the country.

"When we were discussing about the comprehensive CPI data we were looking for a department which had reach across the country. We zeroed in on the postal network," said Pronob Sen, adviser in the Planning Commission and former chief statistician of the country.

It was a perfect opportunity for the postal department, which readily accepted the offer. Rising competition and new technology has posed serious challenges for the department of posts. It is working on several ideas to maximize revenues and use its vast network to help other government departments.

"We were looking at new avenues for raising our revenue and we entered into a memorandum of agreement with the ministry of statistics and progamme implementation," said Sachin Pilot, minister of state for communications and information technology.

He said the rural CPI data is being collected by 1,181 rural post offices. About 1,800 employees undertake the exercise for 3 to 4 hours a week. The statistics ministry paid the department of posts Rs 6.32 crore in 2010-11 and is to pay Rs 7.66 crore in 2011-12. "We just collect the data, the CPI is calculated by the statistics ministry on department of posts and National Sample Survey Office (NSSO) inputs," Pilot said.

Price data is collected from selected towns by the Field Operations Division of NSSO and from selected villages by the department of posts. This data is then fed into web portals being maintained by the National Informatics Centre.

Postal employees identified for the mission were put through intensive training sessions. "They were taught how to collect the data, the questions to be asked and how to put the data in the portal," Sen said, adding most employees had education up to Class 8.

"There were initial hiccups for about 3-4 months but then it settled down. They collect data and then feed it into the computers available in the post office. The data is carefully examined before it is used," said Sen, adding that the department of posts compensates the employees for collecting data.

Data collection in the country faces several hurdles and often international agencies and analysts question the quality of Indian data. Government officials say lack of competitive salaries forces students with economics and statistics background to explore opportunities in the private sector. They say even now the NSSO has vacancies for nearly 800 analysts and statisticians.

The Central Statistics Office on Monday unveiled the first comprehensive annual inflation rates based on the consumer price indices series. Provisional annual inflation rate based on all India general CPI (combined) for January stood at 7.65% while the inflation rates for rural and urban areas were 7.38% and 8.25% respectively, the CSO data showed.

“This Association is against the merger of Inspector Posts and Assistant Superintendents Posts Cadre. Inspector Posts should be granted Grade Pay of Rs. 4600/- with effect from 01/01/2006 at par with Inspectors of CBDT / CBEC in tune with directions of the Hon’ble CAT, Ernakulam Bench”.

In view of the above resolution, it is requested that action may please be taken to implement the orders of Hon’ble CAT, Ernakulam Bench to upgrade the grade pay of Inspector Posts from Rs. 4200/- to Rs. 4600/- with effect from 1.1.2006.

Clarification of CS, Odisha Circle Branch on some comments in the posting titled "Letter of CS, Odisha Circle Branch to GS on GP issue and removal of inter-Circle anomaly on promotion to ASPs"

The stand of Odisha Circle which remains consistent throughout is that any condition to get GP of Rs.4600/- for IPs is acceptable. As some ASPs (not from Odisha Circle) are greedy for surrendering Gazetted status, some say that Directorate can even consider retaining Gazetted status for existing ASPs. That way Odisha Circle Branch has nothing to object because at least we can move for resolving the deadlock. Let me mention it once again that Odisha Circle is even agreeable to acceptance of nomenclature as IPs for the merged cadre, provided GP of IPs is immediately upgraded to Rs.4600/- with all consequential benefit w.e.f 01.01.2006. Odisha Circle only pleads that Chief PMG should be made the appointing authority for the merged cadre as in the case of ASPs at present. To get correct information about the stand of Odisha Circle it is once again requested to go through the related previous postings in this blog, particularly the posting titled: "A complete U turn marks the Begaluru Conference". It is worthwhile to mention that the obsession of Gazetted status which is false by all practical measurement is the main obstacle on the way of getting the GP upgraded. The cadre members in Odisha Circle will have no regret in shedding this falsehood if it helps getting GP of IPs upgraded to Rs.4600/-.

In Circles like Delhi, Kerala, Maharashtra,Tamilnadu and West Bengal, Inspector of Posts are getting their promotion toASP cadre in 5 to 7 years of service in IP cadre. On the other hand, in Circleslike Assam, Bihar, Chhatisgarh, HP, MP, NE, Odisha and Uttarakhand, Inspectorof Posts are getting their promotion to ASP cadre in 10 to 14 years of servicein IP cadre. At the AIC this particular aspect was not discussed.

I write to emphasise the need for the CHQto consider this issue seriously to help remove the above mentioned inter- Circleanomaly so that the time taken by an IP to get promotion to ASP cadre becomes uniformthroughout the country. In this connection, I would like to request you to takeup this issue at appropriate level, preferably in Cadre Restructuring Committeefor up-gradation of Inspector of Poststo Asst Supdts of Posts in Circles like Assam, Bihar, Chhatisgarh,HP, MP, NE,Odisha and Uttarakhand at least to getmore number of ASP posts than the postsof IPs existing in these Circles so that the IPs in these Circle are saved from unfair treatment in gettingthe promotion to ASPs unlike their counterparts in other Circles.

Railway could go Air India way if money not pumped in: Trivedi

NEW DELHI: Railway minister Dinesh Trivedi today cautioned railway could go the Air Indiaway if money was not pumped in the cash-strapped national transporter, as an official committee proposed cess to generate money to upgrade safety mechanism.

Trivedi said government should "prioritise" its focus while considering railways' financial condition as it adds to the GDP and directly affects the common man.

"I am afraid it ( Indian Railways) can go Air India's way," he told reporters here while reminding of the government's bail-out to Air India. Trivedi said "government must sincerely consider helping railways at least on the safety issues" which he contended has been compromised due to its financial position. The railway minister's comments came on a day when a high-level safety review committee set up by him concluded in its report that railways is on "the brink of collapse" and suggested a slew of measures including imposing safety cess on passengers to meet the upgradation expenditure and curtail introduction new trains. TheKakodkar committee said railways' finances were on the "brink of collapse" and advocated against introduction new trains as line capacity has been "severely constrained" due to addition of more and more services year on year. The committee in its report has suggested an investment of Rs 1 lakh crore to upgrade its safety-related infrastructure, especially focusing on the 19,000km high density trunk route.

Statistics indicate railways is almost running in a negative zone and a high operating ratio which is hovering around 100 per cent.

Hundred per cent operating ratio means railways earnings are less than it expenditures.

The DOPT has at last cleared the Cadre Restructuring Proposal. There has been a reduction of 398 posts in the Group-A cadres up to the level of DCIT. The proposal in respect of Gr.B & Gr.C have already been cleared by the Department of Expenditure and Finance Minister without any changes. Now the cadre restructuring proposal is expected to go to the Group of Secretaries and then to the Cabinet for clearance. Shri Permanand writes to the GS on GP upgradation issue of IPs

Dear Ingle Sir,

First of all hearty congratulations for becoming General Secretary of the Association. From the resolution passed in the All India Conference at Bangalore (as mentioned in some of the blogs of Circle Associations), we are very much hopeful for getting Grade Pay of Rs.4600 for Inspector Posts w.e.f. 01.01.2006.

2. Our prayer as requested in the OA No. 381/2010 before Hon’ble CAT is reproduced below (as mentioned in para 11 of the CAT order):

i) To declare that the applicants are legally eligible and entitled to grant of the revised pay structure of Grade Pay of Rs.4600/- in the Pay Bank PB-2 which were granted by way of normal replacement pay structure of Grade Pay of Rs.4200/- in the Pay Band PB-2 in terms of Annexure A-9 Office Memorandum dated 13.11.2009 and denial of it to the applicants is arbitrary, discriminatory and violative of Articles 14 and 16(1) of the Constitution of India.

ii) To issue appropriate direction or order directing the respondents to grant the applicants 1 and 2 the revised pay structure of Grade Pay of Rs.4600/- in the Pay Bank PB-2 as it has been granted to Inspectors in CBDT/CBEC and Assistants in Central Secretariat Service recruited through Combined Graduate Level Examination Scheme A by the Staff Selection Commission with effect from their date of entitlement with consequential benefits including arrears of pay nd allowances within a time frame that may be fixed by this Tribunal.

3. Hon’ble CAT has considered the factors like the source and mode of recruitment/appointment, qualifications, the nature of work, the value thereof, responsibilities, reliability, experience, confidentiality, functional need, etc. in accordance with the Apex Court Judgment in the case of State of Madhya Pradesh v. Ramesh Chandra Bajpai, (2009) 13 SCC 635 and justified the parity established by the Central Pay Commissions between Inspector Posts and Inspectors in CBDT/CBEC & Assistants in CSS.

4. The parity of Inspector Posts with their counter parts in CBDT / CBEC & Assistants in CSS established by the 5^th& 6^th Central Pay Commissions has been emphatically justified by the Hon’ble CAT Ernakulam Bench in its order dated 19^th October’2011 in the OA No. 381/2010.

5. Hon’ble Tribunal views mentioned in the various paras reproduced below may kindly be seen:

Para 26: From the perusal of the Recommendations of the Pay Commissions it could be easily discerned that the Pay Commissions have suggested certain measures relating to introduction of element of direct recruitment which was conspicuously absent earlier and without which comparison with the Inspectors in other Departments/Ministries could not be made. Once direct recruitment has been introduced,it was to the full satisfaction of the Pay Commission, which had in fact commented, "The Commission is recommending the merger of pre-revised pay scales of Rs 5500 - 9000 and Rs 6500 - 10500 which will automatically bring Inspector (Posts) on par with Assistants in CSS/Inspectors and analogous Posts in CBDT and CBEC."

The import of this observation of the Pay Commission is that the Pay Commission was very much interested to ensure pay parity of Inspector (Post) with Assistants of CSS and Inspectors and analogous posts in CBDT and CBEC.

Para 30: This Tribunal need not have to labour more to arrive at the finding that the functional responsibilities of the Inspector (Posts) are certainly onerous and evidently, it is on the basis of adequate justification that the successive Pay Commissions have appreciated the need to revise the pay scale of Inspector (Posts).

Para 31: The decision of the Ministry of Finance does not appear to have taken into account the clear recommendation of the Sixth Pay Commission nor for that matter the full justifications given by the Department of Posts.

6. Moreover, Hon’ble CAT Ernakulam Bench has specifically stated in para 33 of its judgment dated 19^th October’2011 that “

".....the case has been considered and the Tribunal is of the considered view that there is no justification in denying the Inspector (Posts) the higher Grade Pay of Rs 4600 when the same is admissible to Inspectors of other Departments with whom parity has been established by the very Sixth Pay Commission vide its report at para 7.6.14 extracted above........"

7. Hon’ble CAT has allowed the OA to the extent that keeping in tune with the observations of the Sixth Pay Commission, coupled with the strong recommendations of the Department of Post and also in the light of our discussion as above, first respondent, i.e. the Ministry of Finance shall have a re-look in the matter at the level of Secretary and consider the case of the Inspector (Posts) for upgradation of their grade pay at par with that of the Inspector of income tax, of CBDT and CBEC.

8. In view of above, Department may be asked to expedite the process for implementation of Hon’ble CAT judgment regarding grant of Grade pay of Rs.4600 to Inspector Posts w.e.f 01.01.2006 as already given to Inspectors in CBDT/CBEC & Assistants in CSS.

9. As three months from the issue of Hon’ble CAT order is already over, a legal notice may be served to the Respondents, if required.

Minutes of 37th All India Conference held at Bengaluru on 28th & 29th January 2012

The 37^th All India Biennial Conference of our Association was held at Bangaluru on 28^th and 29^th January, 2012. Out of 22 circles, 234 delegates from 19 circles attended and actively participated in the deliberations. There was no representation from Assam, J & K and Himachal Pradesh circle branches.

Deliberations on following issues have been taken place and approved by the august house.

1. Confirmation of the minutes of Biennial Conference of the Association held at New Delhi on 3^rd and 4^thApril 2010.

Shri Roop Chand, General Secretary read out the minutes of the 36^th AIC held at New Delhi on 3^rd and 4^thApril, 2010 and it was unanimously approved by the august body.

2. Approval of Biennial report of CHQ for the period from 02/04/2010 to 26/01/2012.

General Secretary read out the report and it was unanimously adopted and approved by the house.

3. Approval of Audited accounts of CHQ for the period from 02/04/2010 to 26/01/2012.

Shri Jeetram, CHQ Treasurer presented the accounts for the period from 02.4.2010 to 26.1.2012. The Treasurer answered/clarified to queries raised by members satisfactorily and accounts were finally passed by the house.

4. (a) Upgradation of grade pay of Inspector Posts from Rs. 4200/- to Rs. 4600/- w. e. f. 01/01/2006.

General Secretary explained that determination of the pay structure is the job of experts sitting in Pay Commissions entrusted with the specific job and the Government cannot attempt selective revisions without addressing its impact on analogous cadres. Having restored parity by virtue of the recommendations of Fifth Pay Commission, the Government can not try to undo the same and create a blatant discrimination between analogous cadres. Strange it is to find that the Ministry of Finance, having disturbed the relativities are trying to find new logic to deny the well merited parity to the cadre of Inspectors and Assistant Superintendent Posts.

The consistent attempts by this Association to bring into focus all these facts to the Department and to the Government have fallen into deaf ears. Instead the Department has been toying with the idea of abolishing the cadre of Assistant Superintendent Posts and merging the two posts into one without any specific assurance to enhance the career progression of this cadre. The posts of Assistant Superintendents exist in the Department from the inception of the cadre of Inspector of Post Offices and the Assistant Superintendents are the second level officers in the Postal Division and in reality the de facto administrators of the Postal Division. Assistant Superintendent Posts were conferred with ‘Gazetted status’ in the year 2005 as the Government was convinced that the nature of duties performed by them are higher and the responsibilities shared by them are unique to the Department and therefore deserve a higher level of recognition and now just to remove the man-made anomaly which has caused undue discrimination to the cadre of Inspectors, neither the Department of Posts nor the Government can demand our passive and unconditional acceptance to the merger of the Inspector and Assistant Superintendent Posts which have different degrees of responsibilities. While the Department has rightly recognized the need to place the Inspector Posts in higher pedestal on par with Inspectors of CBDT/CBEC and accordingly recommended to the Ministry of Finance also, the same Department cannot now demand unconditional acceptance from our Association to accept an unified single cadre of Inspectors or unilaterally alter the cadre structure for the simple reason that the MOF does not accept the proposal from the Department to restore parity without any valid reason and such a step would definitely be retrograde in nature.

The Hon’ble CAT, Ernakulam Bench has dealt at length the background of our claim seeking parity and has rightly appreciated our earnest efforts to secure parity with the Inspectors of CBDT/CBEC and has therefore allowed the OA with further directions to the Ministry of Finance to have a re-look in the matter at the level of Secretary and consider the case of the Inspector (Posts) for upgradation of their grade pay at par with that of the Inspector of Income Tax, CBDT and CBEC and to consider upward revision of the grade pay of ASPs as well.

Opinion of all Circle branches was obtained. Shri.S.Samuel ex-General Secretary, Shri.G.P.Lahiri ex CHQ President and Shri.P.R.Satyanarayanan ex CHQ President spoke in length about the circumstances under which the post of ASP was sanctioned and how gazetted status was obtained after a long struggle. While all other cadres in the central government are expanding their cadre strength and number of posts, why this cadre alone is asked to surrender the promotional avenues and go backward. Finally, the house decided to oppose merger and passed the following resolution:

“ We are against the merger of Inspector Posts and Assistant Superintendents Posts Cadre. Inspector Posts should be granted grade pay of Rs. 4600/- w. e. f. 01/01/2006 at par with the Inspectors CBDT/CBEC in tune with the direction of the Hon. CAT Ernakulam Bench”.

(b) Restructuring of Inspector Posts cadre and Second CRC.

The Second Cadre Review took place in the year 1986. The Committee recommended upgrading 245 posts of ASP to PS Group B. A Presidential order was also issued in this regard but till date it was not implemented by the department. Here also the Department Expenditure created a mess of it. Now the department is talking about another CRC after rendering injustice to this cadre by its failure to implement the earlier one. The department has constituted a Committee under the chairmanship of Shri. Ashutosh Tripathi, Chief PMG, M.P Circle. The terms of reference to the committee are as under:

(1) To revisit the norms for creation of new Postal Division and Regions as well as upgradation of Class II Divisions into Class I Divisions.

(2) To study the feasibility of organizational restricting of fields formations (Circle and below) keeping in view the emerging needs for India Post in new socio-economic environment.

(3) Review of norms for upgradation of Post Offices.

(4) To study the feasibility of strengthening / creation of Postal Assistants/ Sorting Assistants posts in view of increased need of System Administrators.

(5) Any other relevant issue as may be assigned by the Competent Authority later.

(6) The time period of this Committee to submit its recommendations is three months.

Here also the department is planning to upgrade Class II divisions into class I divisions which will mostly beneficial to IPoS officers only. Many of the Class II divisions in which promoted officers are working are likely to lose promotional prospects. The house decided to deal with the subject separately without linking it with up-gradation Grade Pay to IPs.

(c) CAT Ernakulam Judgement dated 19/10/2011 in OA No. 381/2010.

General Secretary informed that Directorate would be submitting the required information in this regard to MoF. The house requested the General Secretary to pursue the case at appropriate level and see that the orders of Hon’ble CAT is implemented.

(d) Regular promotion to PS Group B cadre.

General Secretary elaborated the issue and informed the house that two DPCs had already been convened, one on 27/11/2011 & the second on 17/11/2011. Total 344 members have been promoted to PS Group B cadre and supplementary DPC is also likely to be convened soon.

(e) PS Group ‘B’ and Sr. Postmaster Examination.

General Secretary informed that the examination for the promotion to the cadre of Sr. PM was notified by the Department to be conducted on 31^st December 2011. Department took a decision not to allow ASPs for the examination. This order was challenged before the CAT Chandigarh and Hyderabad. Finally, Department postponed the examination until further orders. Both the cases are still pending before the Honourable CATs. Department has notified the date of PS Group B examination on 27^th May 2012 and Sr. PM Examination in November 2012 without waiting for the final decision of Honourable CATs.

The representatives of Maharashtra, Kerala & Odisha participated in the discussion effectively and pointed out that ASPs & adhoc PS Group B officers should also be made eligible for Sr. Postmaster examination. It was finally decided that the CHQ will take up the matter with Directorate.

(f) & (g) Provision of infrastructure to Sub Division / Re-organisation of sub divisions.

Many of the sub-divisional offices are functioning from sub-standard accommodation. The venture into new area of business development, Rural PLI etc. has increased the work load and public contact in many folds. Hence, the house requested the department to provide proper justified accommodation to all Sub Divisions.

(h) Supply of Laptops / computers with broad band connection for all Inspector Posts / ASP except Sub Divisional Heads.

Secretary Posts, in her address in the last AIC New Delhi assured to supply Laptop not only to Sub Divisions but also to all IPs/ASPs working in other offices. Supply of Laptops has commenced to all Sub Divisions but yet to reach to few more Sub Divisions. Representatives of Karnataka Circle informed the house that none of the Sub Divisions in their Circle has been supplied with Laptop. Circle Secretaries of Rajasthan & Punjab also took part in the discussion and it was unanimously decided that CHQ will take up the case with Directorate for supply of Laptops to all IPs & ASPs including pending sub divisions. Though Lap top have been supplied partially, broad band connections are yet to be provided.

Issue of combined All India Seniority List of IPs from the year 1999.

It has been decided that CHQ will get the information through RTI.

(j) Revision of rates of remuneration for Invigilator duty.

GS informed to the house that, the case has already been taken up with the Directorate and it is under consideration.

(k) MACP scheme.

GS appraised the house that, DOPT has already framed rules and regulations and therefore our Department could not make any changes therein.

(l) Decentralization of PLI / RPLI work to divisions.

Delegates from circles participated in the discussion and it has been decided that, separate set-up with full fledged manpower consisting of MTS, PAs, IPs, ASPs & AAOs should be provided in all divisions for smooth functioning of PLI/RPLI work. CHQ will take up the case with Directorate.

(m) Women and Youth participation in the activities of the Association.

GS made an appeal to all circles to motivate and increase the participation of women & youth members Circle and CHQ level activities. Women and youth members should be encouraged for effective participation in Association activities. They must be roped in for organizational work by electing them to Circle/CHQ body. Smt.T.V.Sundari, AGS-I commended the excellent work done by women members of our Association particularly women IP/ASP from Karnataka Circle in the successful conduct of the All India Conference.

(n) Activities in the Association with PSI.

Shri. Dinesh Khare, President, Smt. T.V.Sundari AGS-I and Shri.Manjunatha Huballi informed the house various work place campaigns, seminars/workshops organized in Tamilnadu/Karnataka Circles in co-ordination with Public Services International (PSI). The President stated that Karnataka Circle was always associated with PSI and its affiliates in the state of Karnataka and he desired that CHQ might continue the Trade Union activities in co-ordination with PSI.

(o) Any other item with the permission of the chair.

Many circles participated in various issues effectively and placed the following demandeds:

i. Rule 38 cases to be considered quickly.

ii. The cases of surplus qualified candidates should also be considered quickly.

iii. Clerical assistance to the sub divisional head.

iv. Delay in MACP cases in MP circle

v. Negative Valuation in all examinations.

vi. Cases of up-gradation of ASPs in the scale of Rs. 7450/- as per Fifth Pay Commission.

vii. Non-payment of RPLI incentives since 2009 to sub divisional heads in Karnataka Circle.

CHQ will take up these cases with the Directorate.

5. Organisational review.

The august body took review of organization functioning. GS informed that CHQ took efforts and revived the defunct Branch of Jharkhand Circle. But despite such efforts in J&K, the defunct Branch in that circle remains defunct.

6. Financial review.

The financial position of CHQ is not so sound. GS informed the house that Circle Branches are not prompt in remitting 40% due quota to CHQ as required vide Article 39 of our Association’s Constitution. He appealed to all Circle Secretaries to remit the CHQ quota in full and in time so that the CHQ could function effectively.

7. Merger of Postal Officers’ Association, India with All India Association of Inspectors & ASP.

Members mooted the idea of merger of our Association with Postal Officers’ Association India. After a detailed discussion it was decided not to go with merger proposal.

8. Postal Inspector / CHQ blog.

GS explained the house that due to want of fund/support from circles, the mouth piece of our Association could not be brought out monthly. “Postal Inspector” can be published every month or at least on quarterly basis if all members subscribe to it. Circles can also extend support by placing a constant demand for certain number of copies by remitting subscription in advance.

9 & 10. Approval for draft resolutions / Amendment to Constitution.

In all, 7 resolutions are adopted unanimously by the august house.

i) To amend Article 38 of the Constitution; this stipulates a monthly subscription of Rs. 30/- from every member increasing the same to Rs. 50/- p. m.

ii) To amend Note 2 below Article 44 (a) inserting the word “or Assistant Circle Secretary” after the word ‘Organising Secretary’.

iii) To provide separate establishment at Divisional Level for carrying out works related to PLI / RPLI consequent upon decentralization. The work relates to verification of policies and sanctioning claims to be got verified by a separate Accounts Officer or divisional accountant rather than by the ASP (HQ). The Association also resolved to request the Department to issue clear cut orders with respect to payment of incentives and to clear all pending incentive bills of IP / ASP at the earliest.

iv) To conduct DPC for PS Gr. B in time. Instructions issued by DOPT to prepare an extended panel should be followed scrupulously and the department should into consideration vacancies that arise out of unforeseen circumstances including cases of unwillingness. This will reduce the increasing number of adhoc promotion given in PS Gr. B cadre in the Circles.

v) To urge the Secretary (Posts) to give direction immediately to Chief PMG Tamil Nadu to withdraw the cluster transfer policy being adopted in that circle for IPs/ ASPs; this is causing much resentment among the members of Tamil Nadu.

vi) To urge the Department to clearly lay down the roll of the Sub Divisional Head while handling loss and fraud cases which exceeds the limit of Rs. 20000/-. While monetary limits are fixed for officers at various level including DPS and PMsG, responsibilities of SDIs are not clarified with clear guidelines which should be put in place.

vii) We are against the merger of Inspector Posts and Assistant Superintendents Posts Cadre. The grade pay of Inspector Posts should be upgraded to Rs. 4600/- w. e. f. 01/01/2006 at par with the Inspectors CBDT/CBEC and analogous cadres in other Central Government ministries/departments in tune with the direction of the Hon. CAT Ernakulam Bench.

A Complete U turn marks the Bengaluru Conference

A number of queries have been raisedover phone to the Circle Secretary to know the outcome of Bengaluru Conference,particularly in the matter relating to upgradation of GP. A brief report in this connection has alreadyappeared in the blog of AIAIASP, Kerala Circle Branch. Our CHQ blog has published the list ofoffice-bearers elected for new term but the brief of the discussions made and decisionsarrived at the AIC, Bengaluru is yet to be published. In this situation it is felt expedient tomake everybody aware of what happened to GP upgradtion issue at the biennialAll India Conference of the Association held from 27.01.2012 to 29.01.2012 atBengaluru.

It may be recalled that in the lastmeeting of the Cadre Restructuring Committee held under the Chairpersonship ofMember (P), our Association had made a mention that the Association wouldrevert back to the Department with a definite opinion to be obtained from theAIC, Bengaluru on the proposal of merger of IP and ASP cadres. On this background and in accordance with theagenda of the AIC, the Association made a deliberation on the issue.

As expected, the GP issue took thecentre-stage of the discussion taking three time-slots – first, in theafternoon of 28.01.2012, second- in the evening of 28.01.2012 and finally, inthe afternoon of 29.01.2012.

Sri P R Satyanarayana, formerCHQ President who attended the AIC as aninvitee opined that the Gazetted status of ASPs is a prestige for the cadre andit is not negotiable since the prestige cannot be measured in terms of money. SriS Samuel, former GS who attended the AIC as an invitee gave a strong opinionagainst surrender of Gazetted status of ASPs. He recollected his days duringthe tenure of R Ganeshan, the then DG (Posts) when he could obtain the Gazettedstatus for ASPs after a persistent pleading. Sri Samuel compared the Gazettedstatus of ASPs with a dress of a person and made an emotional speech saying thatthe Department is trying to undress the cadre by taking away the hard-earnedGazetted status.

As evident from the above, themajority of the Circle Branches gave opinion in favour of the proposal ofmerger of IP and ASP cadres but were opposed to the proposal of withdrawal ofGazetted status of ASPs. The house decided to draft a resolution accordinglyfor submission to Directorate.

In the evening on 28.01.2012, theissue came up for discussion once again as one section of members opined thatthe issue requires reconsideration keeping in view the practical aspect ofimplementation of the proposal of upgradation of the GP of IPs with referenceto the opinion formed by the Association in the AIC. The verdict of theHon’ble CAT, Ernakulum Bench was alsokept in view.

Opinion of Circle Branches wassought to the proposed resolution to place before the Department to the effectthat:

· IPand ASP cadres should be merged and the merged cadre should have the nomenclatureas ASP.
· Themerged cadre will be of non-gazetted status but the existing ASPs will retaintheir gazetted status as a personal one till their promotion to PS Gr. B orretirement, as the case may be.
· Themerger should be given retrospective effect from 01.01.2006 with allconsequential financial benefit including benefit on account of MACPS from01.01.2006 to all concerned members. Drawal of arrears (with omission of promotion to ASP cadre) shouldbe on priority.
· TheGovt. should make adequate promotional benefit for the merged cadre to ensurespeedier promotion to PS Gr. B cadre.

Asa complete departure from the opinion formed earlier on the day, the majorityview rejected the proposal of merger of IP and ASP cadre and placed reliance heavilyon the judgement of the Hon’ble, CAT, Ernakulum Bench for allowing upgraded GPto all cadres i.e. IP, ASP and PS Gr.B. It was decided to assist Sri Permanandin pursuing the case if there is any need for it. It is to mention here that Odisha Circle had aview different from the majority opinion. Odisha Circle pleaded that since theGP upgrdation case was fought by an IP on individual capacity, the Association as a representative body of the entire cadre should think of the issue independentlykeeping the viability of the opinion of the house in view for implementation of the proposal so as to get parity of IPs with Inspectors of CBDT and CBEC on GP issue as per the originaldemand and sought opinion of house to pass a resolution to facilitate the Govt.to implement it at the earliest so that all members of the cadre could get financialbenefit. The CS Odisha also mentioned that in the judgement of the CAT,Ernakulam Bench has mentioned that GP of counterparts of PS Gr. B officers in CBDT/CBEC is Rs.5400/- which is not true. Themajority onion ignored the view of Odisha Circle. However, Odisha Circle hasconsistently pleaded for accepting the merger proposal of IP and ASP cadres sothat the IPs could get GP of Rs.4600/- at the initial stage from 01.01.2006 atpar with Inspectors of CBDT/CBEC and also could get GP of Rs.5400/- at thestage of MACP –III which is not otherwise possible in the existing situation.Such views have appeared in the blog of Odisha Circle Branch a number of timesbesides being expressed before the CHQ all the time.

Draft resolution was moved on29.01.2012 afternoon in accordance with the decision taken on 28.012.2012. There are two draft resolutions on GP issuewith the hope that the house may review its decision taken in the evening on28.01.2012. Shri Mohanrangam of TN Circle who was the Chairman of theresolution drafting committee read out the resolutions.

The draft resolution No.1 was :

· IPand ASP cadres may be merged and the merged cadre should have the nomenclatureas ASP.
· Themerged cadre will be of non-gazetted status but the existing ASPs will retaintheir gazette status as a personal one till their promotion to PS Gr.B orretirement, as the case may be.
· Themerger should be given retrospective effect from 01.01.2006 and upgraded GP ofRs.4600/- should be granted to the merged cadre w.e.f 01.01.2006 at par withInspectors of CBDT/CBEC in tune with orders passed by Hon’ble CAT, ErnakulumBench and all consequential financial benefit including benefit on account ofMACPS from 01.01.2006 to all concerned members. Drawal of arrears (with omission of promotion to ASP cadre) shouldbe immediate.
· TheGovt. should make adequate promotional benefit for the merged cadre to ensurepromotion to PS Gr.B cadre within 8 to 10 years of service in merged cadre.

Thedraft resolution No.2 (alternative) was:

The Association is against the merger of Inspector Posts and Assistant Superintendents Posts Cadre. Inspector Posts should be granted grade pay of Rs. 4600/- w. e. f. 01/01/2006 at par with the Inspectors CBDT/CBEC in tune with the direction of the Hon. CAT Ernakulam Bench

Thehouse in the majority opinion accepted the second resolution rejecting themerger proposal altogether as per first resolution.

It may be recalled at AIC held inNew Delhi in April 2010, the Association was in favour of merger of IP and ASPcadres on the ground that the nature of duties performed by both IPs and ASPsis same and the merger would not cause any functional disturbance between twocadres. The question of Gazetted status asan obstruction on the way of merger arose subsequently after the delegationcomprising the former GS and new GS met the then Member (P) with mergerproposal. In a departure from the decision taken in the AIC, New Delhi, the CWCin its meeting held at Ambaji (Gujarat) in December 2010 the Association passeda resolution for merger of ASP cadre with PS Gr.B Cadre.(Odisha Circle wasabsent in the CWC meeting at Ambaji). When this proposal did not found a favour withDirectorate, the Association discussed the issue again in the CWC meeting held atPatna during September 2011. The majority opinion was against surrender ofGazetted status of ASPs.

Looking back at developments from AIC, New Delhi in April 2010 to AIC, Bengaluru in 2012 with two CWC meetings inbetween, the Association has done acomplete U turn in the matter of merger of IP and ASP cadres for facilitating upgradationof GP of IPs to Rs.4600/-. While the Odisha Circle Branch wishes all successfor the new GS and his team, it is to be seen how the new GS who himself has astrong view in favour of retaining Gazetted status of ASPs handles the issue ofupgradation of GP of IPs and brings justice for all members of the cadre, giventhe fact that further delay will only lead to anxiety and frustration amongmembers of the cadre.

Life insurance sale must be need based, says IRDA

The sale of life insurance policies are set to become more scientificsoon.

The life insurers should ensure a need-based sale of life insuranceproducts by their direct sales personnel, the Insurance Regulatory andDevelopment Authority said in the draft guidelines on product matrix releasedon Tuesday.

“It is important and necessary for insurers to have in place asuitability index (or a prospect product matrix) that can serve as a selfgoverning tool to assess the quality of sale,” Mr J. Hari Narayan, Chairman,IRDA said.

As per the draft guidelines, an insurer or a distributor must makereasonable efforts to obtain a consumer's suitability information prior tomaking a recommendation to the consumer on a product.

Suitability information means information should include factors such asage, annual income and financial resources used for funding the purchase of thelife insurance product besides risk tolerance.

The regulator is planning to bring the product matrix (or need-basedsale) from April 1, 2012.

a) The amount of maximum or aggregate sum assured mentioned as Rs.Ten Lac (Rs.10.00.000/-) in Rules No.7, 14 and 17(e) may now be read as Rs. Twenty Lac (Rs.20,00,000/-) in respect of PLI.
